Privacy policy

This page explains what personal data the shop processes when you buy from menajeonline.com or write to us: why, how long we keep it, who we share it with and how to exercise your rights. Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the protection of personal data and the guarantee of digital rights apply.

1. Who is the controller

Owner: Nuria Jané Virgili. Tax ID (NIF): 36930636L.

Trading name: MENAJE HOGAR JANÉ.

Address: Passeig de Maragall, 94. 08041 Barcelona.

Phone: 933 517 454. Email: hola@menajeonline.com.

For any question about your data, write to us at hola@menajeonline.com or visit the shop.

2. What data we process and why

Your order. Name, email, phone, the delivery or billing address and what you buy. We use them to prepare your order, deliver it or let you know you can collect it, take payment and handle a return or a guarantee claim. The legal basis is the sales contract (Art. 6.1.b GDPR).

The invoice. We issue an invoice for every order; if you ask for it in the name of a company or with other details, we also process the tax ID (NIF) and tax address you give us. Issuing and keeping it is a legal obligation (Art. 6.1.c GDPR).

Order emails. The confirmation, the notice that your order is ready to collect or on its way, and the invoice are sent to the email address you give us. They are part of the contract, not advertising.

Restock alerts. If you ask us to let you know when an out-of-stock product is back, we keep your email and the product in order to send you that alert, and for nothing else. The legal basis is your consent (Art. 6.1.a GDPR), which you can withdraw at any time.

Visit measurement. Only if you accept it in the cookie notice: Google Analytics measures which pages are visited. The legal basis is your consent, and the shop works the same if you decline. The details are in the cookie policy.

When you write to us or call us, we use what you tell us to reply.

We do not send newsletters or advertising by email, we do not build profiles and we do not take automated decisions about you.

3. How long we keep it

Invoices and corrective invoices, 6 years, as required by the Spanish Commercial Code (Art. 30).

The personal data of an order —name, email, phone and addresses— is anonymised 6 years after the purchase, or earlier if you ask us to. The record of the sale remains, with no one attached to it.

A basket that never becomes an order is deleted after 90 days.

Restock alerts, until we send them. If you want us to delete one before or after that, just ask.

Measurement cookies, as stated in the cookie policy.

4. Who we share it with

We do not sell or pass on your data. The following providers process it on our behalf, and only for what we entrust to them:

— Stripe, the payment gateway: it receives the amount, your email and the payment method. Card details go directly to Stripe; the shop never sees them.

— HostHatch, the server the shop runs on, in a data centre in Amsterdam.

— The email provider through which order emails are sent.

— Google, only if you accept visit measurement.

There is a data processing agreement with each of them (Art. 28 GDPR). Apart from them, we only disclose data where the law requires it, for example to the Spanish Tax Agency.

5. Outside the European Union

Stripe and Google may process data in the United States. Both are certified under the EU-US Data Privacy Framework, which the European Commission recognises as an adequate safeguard, and their contracts also include standard contractual clauses.

6. Your rights

You can ask us at any time to access your data, rectify it, erase it, restrict its processing, receive it in a format you can take with you (portability) or object to our processing it. You can also withdraw any consent you have given us, without affecting what was done before.

To exercise these rights, write to us at hola@menajeonline.com or visit the shop at Passeig de Maragall, 94, 08041 Barcelona. We will reply within one month. If we cannot tell that it is you, we will ask you to prove your identity.

What the law requires us to keep, such as invoices, cannot be erased while that obligation lasts: if that applies to you, we will tell you what and until when.

If you think we have not handled your rights properly, you can lodge a complaint with the Spanish Data Protection Agency, AEPD (www.aepd.es).

7. Security

The shop runs over an encrypted connection, and access to order data is restricted to those who need it to handle orders.

8. Changes

If this policy changes, the new version is published on this page. If the change affects what we do with your data, we will tell you beforehand.

May we measure visits?

Your basket and your session run on our own cookies and cannot be turned off. Beyond that we would like to know which pages get visited, using Google Analytics, and for that we do need your permission. If you say no, the shop works just the same and you can change your mind any time from the footer.
